The IEBC has cleared Mac Donald Mariga to vie for the Kibra seat.
The by election will be held on 7th November.
Mariga had petitioned the Independent Electoral and Boundaries Commission after Kibra returning officer Beatrice Muli invalidated his nomination.
Muli invalidated his nomination on grounds that his name was missing from the current register of voters.
While making his ruling, IEBC Chairman Wafula Chebukati said Mariga is a duly registered voter and that he cannot be locked out of the race.
Chebukati said the IEBC rules are meant to be facilitative to voters and candidates and not to lock them out.
“There was no impediment to the complainant being registered s a voter anywhere,” Chebukati said.
Chebukati said the commission needs cash to ensure real time update of the kiems kits.
He said there needs to be a regular and continuous update of the register.
Speaking after the announcement, Mariga said he is ready for the race.
“The Kibra people will decide. They will be my bosses and I am ready to serve them,” he said
