A man has petitioned the Judicial Service Commission (JSC) to remove Supreme Court Judge Isaac Lenaola from office.
He alleges the Judge has engaged in gross misconduct, misbehavior and violation of the Judicial Service Conduct and Ethics.
The Petitioner Damon Oswa sent his petition to the JSC and it was received on 5th February 2020.
In the petition, Osawa said that the Judge has conducted himself in a manner that has eroded public confidence in him as a Judge of the supreme court of Kenya and contrary to the spirit in the preamble of the constitution in disrespect to the family unit and its establishment.
“The above is premised on the fact, knowingly and with intent to break a young family, the Judge with utmost disrespect opted to have an extra marital affair with a married lady. Details and name shall be availed at the opportune time,” Osawa said in his petition to the JSC.
Oswa told the JSC that the Judge’s continued actions have caused the young vibrant family to break up consequently making the minors to be brought up in a single parent setting.
“That I shall avail detailed evidence on the same when need be or requested by yourselves,” he wrote in the petition.
The petitioner added that the Judge’s conduct has cast aspersions on his morals and integrity contrary to chapter six of the constitution and Judicial Service Conduct and as such demeaned the office of the Supreme Court.
He added that the Judge’s conduct and action would ordinarily not build confidence in the general public thus affecting his work as a Judge at the Apex Court.
“It is on the above that I wish to state that the said Judge has miserably failed the integrity test thus ought to be removed from office immediately if the public is to have confidence in the court he presides over,” Osawa said.
When reached for comment, Judge Lenaola said since the petition has been sent to the JSC, he can only respond through the JSC and not through the Press.
“I see that it is marked ‘Confidential’ so why is it in the possession of other people and I do not have it myself?” Lenaola posed.
