A ruling on if suspended Nairobi City Assembly Clerk and his five colleagues are to be put on trial or acquitted has been postponed.
The court postponed the ruling to next week Tuesday 12 after Senior Principal Magistrate Martha Mutuku fell ill.
This is the second time the ruling is being postponed.
It was set to be delivered last week.
Ngwele, his deputy Adah Awour, colleagues PhilomenaNzuki (principal accountant), James Kariuki (senior procurement officer), Fredrick Mwangi (senior finance and planning officer) and Raphael Maluki (proprietor of Primara Ventures) were arrested in August last year and charged with corruption.
The prosecution alleged that they colluded and stole at least shs I million through a tender for supply of books.
The prosecution said the books were never delivered to City Hall despite Primara Ventures being paid.
Ngwele and his colleagues are out on shs 300,000 cash bail each.
Ngwele has survived several attempts to be bundled out of City Hall.
In November 2014, the Industrial Court reinstated him after he was suspended by Nairobi MCAs after a delay in MCAs getting their mortgages.
The MCAs also said that his name had never been taken to the assembly for vetting and approval.
They said this is a violation of the County governments act and the County Assembly services Act.
Before joining City Hall, Ngwele was a Clerk assistant at Parliament.
Ngwele who is the pioneer clerk at the Nairobi City County Assembly latter survived a bitter war with MCAs who occasionally raised the issue of him not having been vetted.
In 2015, the then Eastleigh South MCA Nelson Masiga raised Ngweles issue in the Assembly and MCAS nearly fought over it.
To date, Ngweles name has never been taken to the assembly for vetting and formal approval.
In June 2018, while appearing before the Public Accounts Committee, Ngwele defended himself against claims of irregular transfer of Sh45 million meant for MCAs’ car loan.
Auditor General Edward Ouko had flagged out the transfer in his report saying it was done contrary to the provisions of Public Finance Management (PFM) Act.
The funds were transferred from MCAs’ Car Loan Account to the Operations Account without the consent of the county Finance executive.
In the same month, Majority Leader Abdi Guyo announced the Nairobi County Assembly Service Board had decided to suspend Ngwele and Speaker Beatrice Elachi to allow a probe into graft claims.
Elachi and Ngwele were feuding over tenders in the county assembly, with each accusing the other of impropriety over multi-million shilling contracts.
