A prominent Lawyer living in Kajiado County and who represents ODM Leader Raila Odinga is some personal cases wants Former Kajiado Governor David Nkedienye declared bankrupt.
Lawyer Ojwang Agina says Nkedienye ,the Jubilee Party Gubernatorial Candidate, has taken him round in circles for nine years without paying him.
The Lawyer successfully represented Nkedienye at the High Court in 2013 in a case that sought to disqualify Tarayia Ole Kores from vying for the Governorship in 2013 on a Jubilee ticket over his academic qualifications.
Nkedienye won the case including the appeal Kores filed .The court ruled that both parties pay for the cost of the suit.Nkedienye never paid Agina his legal fees which now stand at Sh 4.4 Million.
Agina filed a notice this week through the Kajiado High Court Deputy Registrar demanding his money in 7 days or else file a bankruptcy case against Nkedienye.
If Nkedienye fails to pay Agina the Sh 4.4 Million by next week,he could be declared bankrupt and thus jeopardise his candidature in the August 9 polls.
A bankrupt candidate cannot run for political or public office, according to Kenyan Laws.
In 2013, Nkedienye succeeded in elbowing Kores out of the race for Governor even after he had been cleared by the IEBC.
Kores was removed from the ballot making Jubilee Party not to have a candidate in the elections.
Among the prominent cases Lawyer Agina has pursued are;
(i) Lawyer for ODM Leader Raila Odinga in a case involving a property in Langata Constituency.Raila Won case after 21 years in court.
(ii)Lawyer for Kisilu Mutua, the man who was released after 41 years in jail after being wrongly accused of killing Pio Gama Pinto in 1965.
(iii)Lawyer for KTN Cameraman Clifford Derrick, together with Gitobu Imanyala. Derrick was the cameraman assaulted by Former First Lady Lucy Kibaki in 2005.
