A dispute has risen between Trident Insurance Company and one of its contracted Insurance agents.
The contention is a commission payment pertaining to a medical insurance policy procured for the staff of Samburu County.
The Association of Kenya Professionals Insurance Agents (AKPIA) filed a complaint with Mr. Diamond Lalji, Chairman of Trident Insurance Company Ltd, on September 13, 2023.
The complaint revolved around the alleged non-payment of a 10% commission.
This commission was tied to a successful tender valued at shs 149,630,188 , which entailed an expected commission of shs 13,406,113 .
Despite the agent sending a demand letter to Trident Insurance Company’s chairman on July 28, 2023, in relation to the Samburu County Government Staff Medical Insurance cover tender (SCG/T/057/2022-23), there has been no response from the company.
In a surprising development, an employee of Trident Insurance Company suggested that the agent should reach out to Samburu County Governor Lati Lelelit for payment.
This suggestion implied that the governor had been “sorted out” and was responsible for handling the payment to the insurance agency.
The agent who is heading to court, is claiming a breach of contract by Trident Insurance Company for failing to fulfill the commission payment and is concerned that there may be an effort to transfer the responsibility for payment to the Samburu County Government.
Such a transfer could potentially result in delays or non-payment.
