Private developer Ameey Homes who are putting up a shs 500 million 11 storey Apartment in Parklands have gone to court and sued a City Lawyer for opposing the development.
Through their lawyer Abdirazak and Company Advocates, its director Yusuf Askar , Ameey said the City Lawyer has no valid reasons to oppose the development.
The 11 storey apartments are coming up at City Park Drive off Limuru Road on LR No 209/7549.
Lawyer David Njeru Ndambiri is opposed to the project.
The lawyer had sued Ameey Homes at Milimani Court in case ELC no. E115 of 2021 causing Ameey Homes unexpected expenses.
Through Wageni and Company Advocates, he later withdrew the suit.
Ameey said Ndambiri has also given several interviews in the media opposing the project and caused them adverse publicity by claiming that NMS approved the construction of 91 housing units without sewer lines.
Ameey said because of the publicity, several investors were considering pulling out of the project.
The developers said Ndambiri has also been harassing workers and asking them to abandon the project.
In an affidavit, Yusuf Askar said they have all the approvals.
Yusuf asked the Court to intervene and order Ndambiri not to interfere in the development.
The affidavit is dated 23rd September 2021.
According to documents from the developer, NEMA, NMS, NCA, Nairobi water and all other concerned bodies okayed the development.
Several neighbors have also written to Ameey homes and the DCI saying they are not opposed to the project as had earlier been alleged.
Addressing media queries, NCA CEO Engineer Maurice Aketch noted that the Authority was aware of some complaints adding that they had responded appropriately.
According to Aketch, they had done due diligence before issuing the construction approval, including getting the relevant records from NEMA and the Nairobi Water and Sewerage Company.
He added that the developer had already sort court’s intervention and obtained orders stopping any suspension of the construction.
On the Engineering issue, the CEO stated that the construction was suspended when they were informed of the withdrawal of the structural Engineer, but the same continued since a new Engineer came in.
