A section of City MCAs have accused deputy Governor Anne Kananu of perpetuating illegalities.
They said that Kananu is presiding over an illegal regime.
In June 2020, the High Court declared the Deed of Transfer of Functions executed between the National Government and Nairobi City County Government as vague and irregular.
Justice Hellen Wasilwa ruled that the deal signed at State House in February 2020 , was not approved by the County Assembly therefore making it unlawful.
The court further declared the transfer of 6,000 county employees and secondment of CEO’s to the Nairobi Metropolitan Services (NMS) as irregular and illegal since the Governor of Nairobi, Mike Sonko was not consulted.
Led by Waithaka MCA Antony Kiragu, the reps faulted Anne Kananu for allowing Education CEC Janet Ouko to execute her mandate, yet she had resigned.
She resigned in January 2019 after falling out with Governor Mike Sonko.
During her resignation, she said she wants to pursue other undisclosed interests.
In January 2021, the then Acting Nairobi Governor Benson Mutura reinstated Janet Ouko as the County Executive Committee (CEC) member in charge of Education.
Kiragu questioned the rationale of Ouko resigning and then being reinstated by then acting Governor Benson Mutura.
Kiragu said Anne Kananu is in office illegally and that she is also presiding over an illegal cabinet.
The reps said the terms of employment of all the CECs expired when Sonko was impeached.
Kiragu also added that Kananu has been employing people illegally and undermining the oversight role of the County Assembly.
“We know how you became the governor but when it comes to oversight, we will not treat you normally. It’s in public domain that on the 7th of January 2019, one Janet Ouko resigned and said that she can no longer work for this county, but we are surprised that she is still in office as the CEC for education and on payroll,” Kiragu said.
He said the process for hiring a CEC member includes advertising, shortlisting, and vetting which was never the case with Ms. Ouko.
When reached for comment , Ouko declined to comment on the matter.
