The Environment and Land court has ordered ex-telecom and Postal Corporation staff to pay rent for the houses they are occupying.
In a ruling, Judge Obaga however spared the occupants eviction from the houses by the registered Trustees of the Teleposta Pension scheme.
The ex-employees in their hundreds, occupy posh houses in Kilimani ,Elgeyo Marakwet road and others on Jogoo road.
According to documents we obtained, they were to buy the houses in 2013.
The 2 and 3 bedroom houses were going for between shs 4 million and shs 5million.
However, after accruing a debt of 2.8million, the ex-employees rushed to court and sued the trustees of Teleposta Pension scheme who wanted them evicted.
The trustees wanted them evicted from the houses since they failed to pay rent and some are said to be too “poor” to buy the houses.
However, after several court cases since 2008, Judge Obaga said, “The applicant (Trustees has the option of levying distress for rent as there are no orders restraining it from doing so,”
All the other cases the ex-telecom staff had filed arguing that they should not pay rent, they should not be evicted and that they should be given the houses freely were dismissed by the court.
