An in-law to Sports CS Amina Mohamed who is embroiled in a shs 150 million land fraud skipped court yesterday.
Farrah Ali Mohamed who is wife to Rashid Jibril a brother to the CS skipped court when she was required to take plea at the Milimani law courts.
Her husband Jibril already took plea.
The prosecution requested for a warrant of arrest against her.
Earlier, the court had ordered her to appear on Monday 24th February to take plea.
The court said it will issue the warrant on Monday next week.
Her husband Jibril was in court seeking the release of his passports.
He was denied.
Sources outside court said the businessman has two Kenyan passports something that is illegal.
Early this year, the prosecution told the court that Amina’s Brother Ahmed Rashid Jibril and his accomplice Farrah Ali Mohamed conspired to defraud a Nairobi businessman Francis Njeru.
They were accused of conspiracy to defraud contrary to section 317 of the penal code.
“On or about 19th of October 2015 at unknown place within the republic of Kenya, jointly with others not before court, conspired to defraud Francis Nyaga Njeru of his parcel of land LR NO. 20273/1 IR 177998/1 valued at Kshs 75,000,000 by entering into a tenancy lease agreement with China Road and Bridges purporting that you were the registered owner of the land . A fact you knew to be false,” the first count read.
In the second count, the two were charged with making a false document contrary to section 347 (a) as read with section 349 of the penal code.
The prosecution said they had intentions to defraud Francis Nyaga Njeru of his parcel of land LR NO 20273/2 IR 176998 valued at kshs 150,000,000.
They were charged with making a title deed LR 20273 IR 176998 in the name of ARJ capital limited purporting to be a valid title issued and signed by Peter Mburu a land registrar.
They were also charged with obtaining registration of land by false pretenses contrary to section 320 of the penal code and forcible detainer contrary to section 91 as read with section 36 of the penal code.
The land in question is located at the Inland Container Depot on Mombasa road and measures 1.59 hectares.
On 24th December last year, a magistrate’s court issued a warrant of arrest against Jibril after he skipped bail.
Jibril was however lucky to be released on a cash bail of shs 700,000 and a bond of shs 2 million.
