A former Lecturer at the Catholic University of East Africa (CUEA) has sued the University for unlawful dismissal.
The lecturer Dr Rosa Ko, has filed a case at the Labour court at Milimani commercial courts in Nairobi.
Dr Ko is an American Citizen living and working in Kenya.
The suit is under cause number 301 of 2019.
She is suing the university for unlawful/ unfair termination of employment and failure to pay terminal dues / salary arrears.
Through Gicheha Kamau and Company Advocates, Dr Ko said in the suit papers that she was employed on 5th November 2013 as lecturer.
She told the court that on 25th February 2014, she was confirmed as a senior lecturer for the initial contract period of three years earning a monthly gross salary of kshs 134, 063 with effect from 1st May 2014.
She says in the suit papers that she rendered effective and dedicated services and her contract was extended by three years from 1st July 2017 to June 2020.
Dr Ko, 43 years old and a Political Scientist said that on 3rd October 2018 while she was in the course of her duties within the university, she was assaulted by one Samuel Nderitu Wakanyua the then acting dean of students.
She said she suffered bodily harm and reported the matter to Hardy police station in Karen and at the Vice Chancellors office.
She was issued with a P3 form and Wakanyyua was arrested and released on police cash bail.
On 26TH October 2018, Samuel Nderitu Wakanyua was charged at Kibera law courts in criminal case number 1340 of 2018.
Wakanyua on 9th November 2018, filed a Judicial review application vide JR misc. application number 431 of 2018 at the High Court in Nairobi to quash criminal case number 1340 of 2018 at Kibera law courts.
Dr Ko told the court that the University Vice Chancellor never took displinary action against Wakanyua which she says is against the University human resources policies and procedures.
Dr Ko said that Samuel Wakanyua was denied temporary orders on 19th December 2018.
Just before the criminal case at Kibera was to come up for hearing, she was served with a show cause notice for allegedly issuing misleading communication to the media on 5th October 2018 on a matter touching on the University without the Vice Chancellors authority.

Dr Ko says that she was latter forced to write a show cause letter and forced to resign.
She is demanding a total of kshs 10,959, 256 from the University for unlawful dismissal and breach of contract.
She also wants the court to declare that the termination of her employment was not voluntary but forced and therefore unlawful.
