Nairobi County Attorney Lydia Kwamboka on Wednesday told a House Committee that the City’s Legal department is underfunded.
While appearing before the Nairobi County Assembly Committee on Delegated County Legislation, she said the department is unable to publish materials for public participation.
She said most City residents have not been informed on the County regulations that are in force.
Kwamboka said the department’s budget is normally diverted to other sectors during the budget making process.
“We have a budget of Ksh. 263 million annually. Two thirds of which is used to pay law firms while the remaining is used to pay salaries. We forward our budget during the making process as the executive legal sector but the allocation is diverted to other sectors,” she said.
Nasra Nanda, the Committees chairperson said the MCAs are inquiring into how the department operates, roles and the written response will enable them exercise their oversight and legislation role.
She said its shocking that City residents haven’t been sensitized about the regulations because funds for publication of booklets are not in place.
She added that the Committee will ensure the funds are not diverted.
“We need to establish where the allocations are diverted to. There could be mischief.” she said.
