Nairobi MCAs on Tuesday resolved to terminate the County Attorney’s Lydia Kwamboka’s contract on grounds of abuse of office.
This comes after residents petitioned the county leadership to sack her.
The Justice and Legal affairs committee chaired by Kahawa Ward Rep, James Komu in its report recommended termination of services of Ms Kwamboka as county attorney in accordance with section 13 of the office of County Attorney Act 2020
The committee found out that she’s practicing nepotism by assigning top offices of the directorate to members of her “tribe disregarding the two thirds gender rule”
“The County Attorney has violated the law and is not fit to hold the office for contravening the Advocates Act and the Law Society of Kenya by purporting to practice without a valid practicing certificate for the year 2020. She has contravened Article 10 of the Constitution on national values and principles of governance; her continued stay in office will continue to cost taxpayers unnecessary costs,” Said Komu.
The MCAs said Ms Kwamboka flouted the provisions of the public procurement and asset disposal act, 2015 through issuance of instructions to non-pre-qualified law firms.
“Awarding contracts to Njenga Maina and Company Advocates to carry legal services for the county depicts the true image of corruption within Ms Kwamboka. The company has been paid ksh 60 million and still demands 300 million which reveals the interests of the county attorney in the law firm,” the reps said.
Kwamboka snubbed the committee’s invite to shed light on the allegations claiming to be attending a swearing in ceremony of the county Acting Governor Ann Kananu which never occurred.
The County Assembly Speaker Benson Mutura has written to the interim City Boss to terminate her services.
“This is to inform you that the Assembly in its Sitting of Tuesday 27th July 2021 at 2.30pm through a motion by the sectoral committee on justice and legal affairs adopted the report on the petition from Mr John Mark Ojiambo on behalf of the Kenyan Citizens, Nairobi residents and Nairobi taxpayers on the request for removal from office of Ms Lydia Kwamboka, the Nairobi County Attorney”
“This is therefore to forward to you the resolutions of the Assembly that: 1. The Ag. Governor Nairobi City County, terminate forthwith the services of Ms. Lydia Kwamboka as the County Attorney; in accordance with Section 13 of the office of the county attorney Act 2020”
“All instructions issued to the firm Njenga Maina and Company Advocates be withdrawn and given to internal advocates or a law firm that is pre-qualified to offer legal services to the County,” read the letter.
