Bishop Edward Mwai has lauded the Judiciary for criminalizing same sex marriages in the country.
Mwai is the general overseer of Jesus Winner Ministry Churches in Kenya.
On Friday a three Judge bench comprising of Judges John Mativo, Roselyn Aburili and Chacha Mwita dismissed a case filed by one Eric Gitari, lesbians and gays, transgender groups among others.
They sought decriminalization of sections 162 and 165 of the law.
The trio while dismissing the case said Kenyans expressed their views on the matter when the new constitution was promulgated in 2010 in section 45(2).
According to the current law a person found contravening these sections, 162 and 165 in public or privately is guilty of a felony punishable by law up to five years in prison.
Section 162 reads, “Any person who – (a) has carnal knowledge of any person against the order of nature; or (b) has carnal knowledge of an animal; or (c) permits a male person to have carnal knowledge of him or her against the order of nature, is guilty of a felony and is liable to imprisonment for fourteen years.
According to section 165 any male person who, whether in public or private, commits any act of gross indecency with another male person, or procures another male person to commit any act of gross indecency with him, or attempts to procure the commission of any such act by any male person with himself or with another male person, whether in public or private, is guilty of a felony and is liable to imprisonment for five years.
