Businesswoman Joyce Akinyi, a Kenyan woman and a Congolese man have been charged with trafficking Narcotics valued at Sh 5. 5 million.
According to court documents, they committed the offense contrary to section 4 (a) of the Narcotic Drugs and Psychotropic substances control Act of 1994.
Joyce Akinyi, Peris Anyango Omondi and Paulin Kalala Musankinshay appeared before Jomo Kenyatta International Airport, (JKIA) Law Courts magistrate Christine Njagi .
They denied the charges.
They were accused that on July 13, 2019, at Deep West Resort within Nairobi County, they trafficked heroine.
Akinyi and Omondi are also charged with possessing forged Democratic Republic of Congo (DRC ) passports contrary to section 54(1)(c) of the Kenya Citizenship and Immigration Act No. 12 of 2011.
They denied the charges.
Through their lawyer John Ogada, Dorcas Osabwa and Elvis Abenga the accused pleaded with the court to be released on favorable bail terms.
In her ruling, Senior Resident Magistrate at JKIA Law Courts, Christine Njagi released Joyce Akinyi and Peris Omondi on a bond of Sh 2,000,000 each with two sureties of the same amount.
“The two persons should report to the police station once every week and not to travel without informing the Court,” ruled Njagi.
Congolese national Pauline Kalala was denied bail.
The court heard that there were compelling reasons in his case and that he had no known contacts in Nairobi and investigations were on going.
“I request the court to grant us all the witness statements, documentary exhibits and inventories of property taken from the accused persons,” said Lawyer John Ogada who represented the accused.
Ogada also asked for the release of Joyce Akinyi’s car and other property which were taken by the police during their arrest.
The magistrate ordered that they file a formal application for the release of the property to enable the prosecution to respond.
The case was fixed for pre-trial conference on August 27, 2019.
